1. Agreement

By using runningwithstrategy.com (the "Site"), you agree to these Terms of Use. If you don't agree, please don't use the Site. The Site is operated by Running with Strategy LLC ("we," "us," "our").

2. What this site is

This Site is an informational website for our marketing studio. It describes what we do, how we work, and how to begin a conversation about a potential engagement. Nothing on this Site constitutes professional, legal, financial, or marketing advice for your specific situation. No client relationship is created by using the Site or submitting the inquiry form.

3. Inquiry submissions

Submitting the inquiry form on /begin does not create a contract. It opens a conversation. Any actual engagement will be governed by a separate, written Master Services Agreement and Statement of Work signed by both parties, which control over anything stated on the Site.

By submitting the inquiry form, you confirm the information you provide is yours to share and is reasonably accurate. Please don't share third-party confidential information through the form.

4. Intellectual property

The Site, including its writing, design, branding, code, photographs, and other content, is owned by Running with Strategy LLC or its licensors. You may view, share, and link to the Site for personal and non-commercial purposes. You may not copy, republish, or otherwise use the content commercially without our written permission.

The "Running with Strategy" name, logo, and related marks are our trademarks. You may not use them without permission.

Case studies, results, and client snippets displayed on this Site (for example, on the Work page) are shown under portfolio rights granted to us in our service agreements with those clients, or with their explicit consent. Client names, logos, results, and project descriptions shown on this Site are not available for use by third parties.

5. Third-party links

The Site links to client websites and a small number of other third-party sites. We don't control those sites and aren't responsible for their content, terms, or privacy practices. Following a third-party link is at your own risk.

6. Newsletter and email

If you subscribe to A Letter, Sometimes, you may receive occasional emails from us. You can unsubscribe at any time using the link in any email. We don't send spam, and we don't share your email address with third parties beyond the service providers necessary to deliver the newsletter (see Privacy Policy).

7. Disclaimers

The Site and its content are provided as is, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Site will be uninterrupted, error-free, or free of harmful components.

Any results discussed on the Site (case studies, growth numbers, client outcomes) describe specific past engagements. Marketing results vary based on business, audience, market, budget, execution, and a hundred other factors. Past results do not guarantee future results.

8. Limitation of liability

To the maximum extent permitted by law, Running with Strategy LLC will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if we've been advised of the possibility of such damages. Our total liability for any claim relating to the Site is limited to the greater of $100 or amounts you've paid us in the prior twelve months (which, for using the Site alone, is zero).

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Site or your violation of these Terms.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there.

11. Changes

We may update these Terms from time to time. Material changes will be reflected in the effective date at the top of this page. Continued use of the Site after a change means you accept the updated Terms.
